Resources Help Industry Navigate New Laws for Residential Land Lease Communities

On 1 November, 2015, residential park laws in NSW will be replaced by the Residential (Land Lease) Communities Act 2013 and the Residential (Land Lease) Communities Regulation 2015, with significant operational changes for residential land lease communities across the state.

These new laws will impact parks with permanent residents living in residential land lease communities, which have been known as residential parks, including caravan parks and manufactured home estates.

In supporting the industry to move through the complexity of the new requirements, the Land Lease Living Industry Association of NSW (LLLIA) has developed a range of member resources, to help businesses understand the new laws and implement the changes.

“These new laws will affect all residential parks in NSW and many operators may be overwhelmed by the new requirements, so the Association has developed a portal for our members to access at any time to help support their businesses to understand and comply with the new legislation,” LLLIA President, Theo Whitmont said today.

“We understand that small businesses can find it difficult to adjust to changes in regulations and legal requirements so we have been very active in making sure we can provide them with the right information in one, easy to access location.

“These resources, available to our members, will help them confidently move forward under the new laws with all the resources they need at their fingertips.”

"Our Association has worked closely with the NSW Government in the development of the new laws which will support both the industry and consumer into the future, and continue to provide affordable housing options for the community.

“Our newly released portal gives member access to a comprehensive manual, templates, fact sheets and policies to help them through the implementation process. In particular, the Association has developed a tool for members to produce disclosure statements and site agreements online, enabling our members to dynamically produce the documents they need in a simple, easy way.

“This portal is about supporting our members to move seamlessly into the new system, saving them time and giving them confidence that their business is compliant with the new laws.”

Some of the main reforms in the new laws include:

  • new arrangements for disclosure of information to prospective home owners
  • new rules of conduct for operators and sanctions for non-compliance
  • mandatory education for all new operators
  • new options for site fees
  • a more effective mediation process
  • improved processes for making, amending and enforcing community rules
  • new rules to clarify and streamline the process for homeowners who wish to sell their home on site
  • the introduction of voluntary sharing arrangements, and special levies for improvements.
